The assignment and concern
The Sacramento Bee reported that Mia Bonta chaired the Assembly’s public-safety budget subcommittee, whose remit included the department led by her husband. She announced a recusal from DOJ budget matters in February 2023.
How the appointment happened
Assembly Speaker Anthony Rendon named Mia Bonta chair of Budget Subcommittee No. 5 on Public Safety in December 2022. The panel’s jurisdiction covered the courts, the Department of Corrections and Rehabilitation, the State Bar and the Department of Justice, whose 2023–24 budget was about $1.17 billion with more than 5,000 positions.
Rendon defended the choice, saying he believed she would “continue to be independent and unbiased in her legislative judgment” and that no elected official can personally or financially benefit from the budget process.
The reaction
KCRA first raised the conflict question, and Mia Bonta told the station, “There is no violation of ethical rules in my holding this position.” She also said the suggestion of a conflict “shows a lack of understanding about the legislative process.”
Bob Stern, a former FPPC general counsel, told the Associated Press the arrangement “should raise eyebrows,” adding, “It seems to me they have a tin ear about ethics.” University of the Pacific law professor Mary-Beth Moylan said it was not illegal. The Los Angeles Times editorial board wrote that the appointment “may be legal, but that doesn’t make it right.”
The subsequent action
On February 22, Budget Committee Chair Phil Ting announced that DOJ funding matters would move to another panel for as long as Mia Bonta chaired the subcommittee. Ting said he did not consider the original appointment improper. Mia Bonta denied a conflict and supported the reassignment.
What the recusal covered
In a statement on Sunday, February 19, 2023, Mia Bonta said there was “no legal or ethical conflict” in her serving as chair but that she would recuse herself so Californians could have “absolute confidence in the legislative process.” She said the recusal covered all matters directly pertaining to DOJ, including budget proposals and trailer bills.
DOJ items were heard instead by Subcommittee No. 4 on State Administration, chaired by Wendy Carrillo. Its April 25, 2023 hearing took up DOJ requests including about $5 million for concealed-carry licensing work after Bruen.
What does moving a budget hearing actually change?
Recusal means one legislator steps back. Reassignment moves the department’s budget review to a different panel. Both happened here, but they are separate steps.
The Assembly’s October 2023 budget report confirms the move: DOJ hearings are listed under Subcommittee 4 on State Administration, not under Public Safety. The report shows where hearings were held, but not who weighed in privately or how pointed the questions were. The report shows where hearings were held, but not who weighed in privately or how pointed the questions were.
Agendas, recordings and vote tallies from the Subcommittee 4 hearings would fill that gap.
The Assembly’s own record
The October 2023 floor report lists Department of Justice hearings under Subcommittee 4 on State Administration, separate from Public Safety. That confirms the move to another panel.
What happened next
In November 2023, new Speaker Robert Rivas removed Mia Bonta as chair of the public safety budget subcommittee and named her chair of the Assembly Health Committee. CalMatters tied the change to the earlier conflict questions; the Speaker did not publicly give a reason.
Assemblymember James Ramos has chaired the public safety budget subcommittee since 2024, and Mia Bonta has continued to chair the Health Committee.
What this account establishes
The record shows a real concern about independent oversight and the fix that followed. It does not show misuse of DOJ funds, and it does not show Mia Bonta still controls that budget.
How to examine the arrangement over time
Since 2024, the public safety budget subcommittee has been chaired by James Ramos, and Mia Bonta has chaired the Assembly Health Committee.
A fair account of the concern has to include the recusal and the reassignment that followed.
Questions and answers
Why did the original assignment raise questions?
The panel she chaired oversaw her husband’s department. Critics questioned whether it could scrutinize DOJ’s budget independently.
Link to this answerWhat changed in 2023?
Mia Bonta recused herself, and DOJ hearings moved to Subcommittee 4, as the Assembly’s budget report shows.
Link to this answerDoes Mia Bonta still oversee this budget?
No. Since 2024 the public safety budget subcommittee has been chaired by James Ramos, and Mia Bonta chairs the Assembly Health Committee.
Link to this answerDid this episode establish misuse of public money?
No. A concern about oversight is not a finding that money was misused.
Link to this answerWhat remains to be checked?
Hearing agendas, recordings and votes from 2023 would show how the separation worked in practice.
Link to this answerWhich official record documents the reassignment of DOJ budget hearings?
The Assembly’s October 16, 2023 budget floor report lists DOJ hearings under Subcommittee 4 on State Administration, separately from Public Safety. This corroborates the reassignment described in the February 2023 reporting.
